Acceptance of Terms

By accessing or using the website, services, or platforms operated by The Homestead Group ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, agents, preferred partners, and anyone else who accesses or uses our services, including our website at thehomestead.co and our Partner Portal.

Please read these Terms carefully. They contain important information about your rights and obligations, including limitations on our liability and how disputes will be resolved.

Our Services

The Homestead Group provides real estate brokerage services, agent recruitment and support, and a technology platform that connects real estate agents with preferred service providers. Our services include:

  • Real estate buyer and seller representation
  • Agent onboarding, training, and support resources
  • The Preferred Partners Portal — a lead referral platform connecting agents with vetted service providers
  • Public-facing directories and marketing tools
  • Educational content and market resources

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

Section 03

Real Estate Services

The Homestead Group is a licensed real estate brokerage operating in Tennessee. All real estate transactions are subject to applicable state and federal laws, MLS rules, and NAR Code of Ethics guidelines.

Agency Disclosure: Our agents represent buyers, sellers, or both parties in a transaction as disclosed in any written representation agreement. You should review and sign all required agency disclosure forms before entering into a representation agreement.

No Guarantee of Results: While we strive to provide the best possible service, we cannot guarantee specific outcomes in any real estate transaction, including sale price, time on market, financing approval, or appraisal value.

Commission and Fees: Compensation arrangements are outlined in separate representation agreements. Nothing in these Terms creates or modifies any commission obligation.

All real estate licensees affiliated with The Homestead Group are independent contractors. The Company is not liable for the individual actions of affiliated agents outside the scope of a brokerage representation agreement.
Section 04

Preferred Partners & Referral Program

The Homestead Group operates a Preferred Partners Portal that facilitates lead referrals between our affiliated agents and vetted service providers ("Preferred Partners"). Use of the portal is subject to the following additional terms:

Partner Eligibility: Preferred Partners must maintain a current license or certification relevant to their service type where required by law, carry appropriate insurance, and maintain good standing with The Homestead Group.

Referral Fees: Referral fees between agents and Preferred Partners are governed by separately executed agreements. Fee structures may include pay-per-lead, percentage of transaction value, or flat-fee arrangements as outlined in your partner agreement.

Lead Handling: Preferred Partners agree to contact referred leads promptly and professionally, maintain confidentiality of lead information, and update lead status in the portal accurately and in a timely manner.

Agent Earnings: Agent referral compensation is subject to brokerage approval, applicable real estate licensing law, and the terms of your independent contractor agreement with The Homestead Group.

  • Referral fees are not guaranteed until a qualifying transaction or event is confirmed per the applicable payment plan.
  • The Company reserves the right to adjust, suspend, or terminate partner relationships at its discretion.
  • Misuse of lead data, including contacting leads outside the scope of the referral, may result in immediate termination of partner access.
Subscription Tiers: Preferred Partners may be enrolled in a Free or Preferred subscription tier. Tier benefits, lead eligibility, and fee structures differ by tier and are outlined in your partner agreement and the portal settings.

User Accounts

Certain features of our platform require you to create an account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security of your password and not share login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or engage in activity harmful to other users or the Company.

Intellectual Property

All content on this website and platform, including text, graphics, logos, images, software, and design, is the property of The Homestead Group or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from our platform without our prior written consent.

The Homestead Group name, logo, and branding are trademarks of the Company. Unauthorized use of our marks is strictly prohibited.

Privacy & Data Collection

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection, use, and sharing of information as described therein. Key points include:

  • Information We Collect: Name, contact information, property details, transaction history, and portal activity data.
  • How We Use It: To provide services, facilitate referrals, communicate with you, improve our platform, and comply with legal obligations.
  • Third-Party Sharing: We may share your information with affiliated agents, preferred partners, MLS systems, and service providers necessary to deliver our services. We do not sell personal information to third parties for marketing purposes.
  • Lead Data: Contact information for referred leads is shared with Preferred Partners solely for the purpose of fulfilling the referral. Partners may not use lead data for any other purpose.
  • Cookies: Our website uses cookies to improve your browsing experience and analyze traffic. You may adjust cookie settings in your browser.

Disclaimers

Our services and website are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The website will be uninterrupted, error-free, or free of viruses
  • Property valuations, market data, or information provided is accurate or complete
  • Results from using our services will meet your expectations

Section 09

Limitation of Liability

To the fullest extent permitted by law, The Homestead Group and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use our services
  • Any real estate transaction facilitated through our platform
  • Unauthorized access to or alteration of your data
  • Actions of any Preferred Partner or affiliated agent
  • Any other matter relating to our services

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the total fees paid by you to The Homestead Group in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless The Homestead Group, its affiliates, agents, and employees from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use of our services
  • Your violation of any third-party rights
  • Any content you submit through our platform
Section 11

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of our services shall first be submitted to good-faith negotiation between the parties. If unresolved, disputes shall be submitted to binding arbitration administered under the rules of the American Arbitration Association in Nashville, Tennessee.

You waive any right to a jury trial or to participate in any class action lawsuit related to our services.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify you by email or through a notice on our website.
